H1B Rejection Package Delay & track

I had filed H1B Petition for 2016 through an employer, whom I got contact through my friend. It seems my petition wasn’t picked up in the H1B  lottery.

As the employer collected more than H1B application filing fee, has to repay me back,  since my petition is not selected in the lottery.

When I asks for the repayment, the employer said as per the company policy,  he needs  to get my  H1B Return package (contains the H1 B Lottery rejection letter) from USCIS. Its been almost more than 2 months, my employer is repeating the same answer, my rejection letter is not received from UCSIS yet.

In this situation, I would like to know the following,

  1. Is the USCIS completed sending all the H1B  rejection letters / Return packages to the applications? If not, what would be last date for the same?
  2. Is there any way to track, why there is a delay in sending my rejection letter by USCIS?
  3. Up to my knowledge,  all rejection letter contains the Reject Case: VRN number, petitioner and beneficiary name  which is the only proof  to know whether the employer has filed petition for me

or Is there any other proof to know that whether the employer has filed H1B petition for me?

Thanks in Advance. Your response would be more helpful, Since I m in a dilemma whether to trust my employer words, since I need to get a quite a big amount from my employer.

    Firstly you are not supposed to pay a single penny to the employer for getting an H1 B Visa.
    Secondly, USCIS sends the rejected documents /letters to the petitioner . Which over here is the employer and not you.
    Lastly, there is no way to track it also as there is no time limit to when you will get a confirmation of rejection.
